* * * NOTICE OF ACCOUNT CLOSURE * * *

Account Name: drizzt6k@hotmail.com
BattleTag: Shoo#1573

A user of the above account has recently been involved in actions deemed inappropriate for Diablo III by the In-Game Support staff of Blizzard Entertainment. This decision was made after a thorough investigation of the situation as a whole. Though we are unable to discuss the outcomes of our investigations due to privacy concerns, rest assured that this incident has been looked into very thoroughly, and the appropriate actions have been taken on all involved accounts.

Account Action: Account Closure
Offense: Scamming another Player
This category includes:
*Acquiring items or any other 'possessions' from another player through misinformation, confusion, or fraud (Scamming)

This Diablo III account has been closed by our staff based on a review of the account and all related policy violations, in accordance with the Terms of Use and our In-Game Policies (http://us.battle.net/support/en/article/300722). Note that any open bids or auctions at the time of the account’s closure have been cancelled. Your open bids will be refunded to your original method of payment. Please allow 5-10 days for processing depending on the availability of your financial institution. Any bids or auctions completed prior to the account’s closure will neither be refunded nor reversed.

Moving forward, this Diablo III account and any Heroes or items associated with the account are no longer accessible. The only way to continue playing Diablo III is to purchase a new license, or to attempt to recover access by appealing account closure. While closure overturns are very unlikely, we advise that customers pursuing an appeal hold off on purchasing a new Diablo III license until the appeal process has completed. If you add a new Diablo III license, a new account will overwrite your old, without any prior Heroes or items from the closed account.

Any disputes or questions concerning this account action can only be addressed by Account Administration. To learn more about how Account Administration is able to assist you, and how to contact them via online ticket, please visit us at http://us.battle.net/support/en/article/300515. We will be unable to investigate account actions over the phone - an online ticket is the only way to contact Account Administration.

We understand that these policies may seem harsh, but they are in place to ensure that every player is able to fully enjoy their time spent on Battle.net. Thank you in advance for respecting our position.

Regards,

Blizzard Entertainment

Dammnnnn that sucks! Simply reply to them that you never scammed, and if they bring up individual trades and go over details simply be like the guy accepted when I put 1 gem so I traded.

This is BS because on their website it says Blizzard will not moderate trades and that users should seek caution when trading or use the RMAH

Were you only scamming? What were the other accounts for?
Were you muted several times before?

guessing the whole gm thing is because you tried getting a rollback when you weren't actually hacked

Are... you... scamming... us!!!

I can't believe you got banned for scamming. It's protected under their TOS. Just look at their scam policy, Diablo3 EULA, and BNET TOU and you will find no potential to be banned for scamming in D3.

Diablo 3 Scam policy
http://us.battle.net/support/en/article ... cam-policy
Literally says that they cannot intervene in a scam.

Diablo 3 End User Agreement
http://us.blizzard.com/en-us/company/legal/d3_eula.html
No mention of scams.
Only mention of not allowing third-party programs, which they did not accuse you of.

Battle.net Terms of Use
http://us.blizzard.com/en-us/company/ab ... ofuse.html
Again, no mention of scams being against agreement.
Only mention is use of third-party programs.
Most concerning part is:
Quote:
BLIZZARD MAY SUSPEND, TERMINATE, MODIFY, OR DELETE ACCOUNTS AT ANY TIME FOR ANY REASON OR FOR NO REASON, WITH OR WITHOUT NOTICE TO YOU. Accounts terminated by Blizzard for any type of abuse, including without limitation a violation of these TOU, a Game-specific Terms of Use, or a Game EULA will not be reactivated for any reason.

However, it still appears to be limited to violating either the D3 EULA or BNET TOU.

Like IAmAlpha suggested. You may have grounds to deny any infringement and request proof of violation of their legal documents.

In WoW i got a 3 day ban and all my gold removed for wrapping up 43 copper fishing poles and sending them as gifts for 3k gold to random lvl 60's on epic mounts... most got returned... made 150k gold and sold it all... just a 3 day ban and all my gold removed (which was 4k at the time) and i came back to 3 more packages received in the mail, so i got 5k even after the ban....

You're basically blizzard's bitch if you agree to their terms. They can do whatever the fuck they want to your account.

I personally think that this is pretty funny.

Well, I must admit, it does appear so according to that line in all CAPS. At the same time, they note in the next line that accounts will not be reactivated when they are terminated for "any type of abuse."

Therefore, although they can TERMINATE your account for any reason, they only state that they will NOT REACTIVATE your account if it was terminated for any type of abuse.

The point being, you would have to show that you did not perform any type of abuse. Or rather, request them to provide proof of abuse having occurred... or else they may have to reactivate you according to their TOU.

That does not mean that they have to prove it..

They probably go so many scam reports for demodian...
And since it's more difficult based on their legal documents to ban for scamming another player... but according to their TOS they can instantly ban for "Attempting to Defraud a GM". They just had a GM go in and record your attempt at scamming them.

Kinda circumventing the "protection" that their scam policies give us.

GJ Blizz, note must of scams are made using auto-it scripts or similar. So if you are not banned for scamming you are banned from using 3rd party software hehe.

Well I know people get banned trying to "fake" hacked accounts to make rollbacks.

But for scamming you should hit a good value of money doing that to get such ban hehe.

Neverthless I laugh alot with this bans.

I had well over 10 accounts banned in WoW for auction house "infractions" like buying out all the righteous orbs and charging 500g a piece for them (in vanilla). Same thing happened in TBC with hearts of darkness. Fuckin bullshit IMO.
