do i have to pay taxes beyond a certain income? i've read that it might be a form of gamble, but poker players also have to pay taxes at certain conditions.

To be honest if you're making lots of money off of this the best thing to do would be declare it as income, and then the tax department will sort out what you pay.

Also depends on the country you are in I assume? In Australia the first $18000 you earn in a financial year is tax free, so assuming you have no other job and you make less than that from diablo 3 even if you did declare it you wouldn't have to pay tax I assume.

i'm from germany and looking at far more than 18k per year.

the tax department calculates how much i have to pay? that would be nice, but i doubt they know exactly how to handle the d3 rmah and might tax me too much.

i'll probably contact a tax consultant tomorrow if i can't get a clear answer by then

the terms of use are saying that all sales are income and i have to pay taxes.

You have to pay taxes on your income per your state's tax laws. I *WOULD_NOT* try to avoid these taxes as if you get caught which you will, you're going to get royally fucked. This has nothing to do with hacking or hiding behind a proxy and whatnot.

Also a word of caution, do know that people will say things that of which they have no clue of what they are talking about, and by you listening to them, regardless of your good or bad intentions, will get fucked by the IRS both financially and legally if the person is wrong (probably are to an extent)

@Benowns - No actually. Their transactional charges are their made up fee for the service which they have every right to do. They use Paypal for a reason, and that is so they don't have to handle the taxes and send out 1099's/report each individual taxes to the IRS at the end of the year. Regardless, you're paying your taxes.

There is, and the answer is you pay it. If you want me to back up this statement unfortunately , the best thing I can do is say contact a professional.

People go to years of training for this type of shit, and some of the laws are complex. It gets even worse if you're not even in the USA. I want to warn you again of people posting with 0 knowledge on the subject, they won't help you when you get a $60,000 tax fraud / evasion and/or jail time , ignorance is not an excuse

Well the thing about this is that you're not actually selling the item. In blizzard's terms they state that you dont technically own the product, so you are essentially recieving a fee for a service provided, which would in the united states prob fall under the capital gains tax scheme, somewhere around 18% prob less...

^ Interesting, makes sense. Either a CPA needs to a chime in or we brainstorm ideas and take them to a CPA. (Or whatever a taxes specialist is called)

I highly doubt all this.

Servers make money they never declare (10k-20k easily a year) and they are basically never touched. There is just an easier trail to follow with paypal.

^ Dude seriously? Paypal reports your income to the IRS if you make more than $500. They are a multi-billion dollar corporation, you'd think they know what the fuck they are doing.
For anybody who is stupid enough to want to break federal law and not report their taxes, especially when dealing with Paypal who DOES* report it to the IRS, please go ahead and be the guinny-pig laughing stock and a test subject for Blizzard's Project Titan RMAH. Have a nice day. I'll stop posting in reply to people who post idiotic things, and will reply to interesting posts.
